Terms of MAZi Platform Cloud Storage Service

These Terms of MAZi Platform Cloud Storage Service (“Terms”) govern your use and access to MAZi Platform Cloud Storage Service (“Cloud Storage Service” or “Service”). Please read these Terms carefully. By using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, do not subscribe to the Service.
MAZi Platform Cloud Storage Service is a technical service related to information storage provided by MAZi Security Company (“MAZi”) to MAZi Platform users based on the MAZi Platform App. The Service itself does not directly upload or provide content, nor does it make any modifications or edits to the content stored by users. Users can store surveillance video captured by their devices through the Service; If your device supports cloud storage, when the Cloud Storage Service is turned on, the device automatically turns on cloud storage to video record activity when the device detects activity within the monitoring range.
Subscription. You will need to contact your installer in order to subscribe Cloud Storage Service.
When you add a subscription of Cloud Storage to your device, you can view any video recorded in the past 7 days when you sign up a 7-day plan, and the past 30 days when you sign up a 30-day plan anytime anywhere. Details of your subscribed Cloud Storage Package could be found in the MAZi Platform APP.
Cloud Storage is subscribed per device. For example, if you own three devices and would like to subscribe Cloud Storage for every device you need to purchase a subscription for each device.
Your subscription of Cloud Storage is bound to your device, while the video clips stored previously cannot be transferred to another account. For example, if the device transfers from account A to account B, the Cloud Storage Service will be transferred accordingly, but with account B you will not be able to view or playback the video clips recorded previously before transferring. Whereas, if the device retransferred to account A, with account A, you can continue view or playback the previous video clips as long as the video clips is still in valid period according to the Cloud Service Package.
Changing the Subscription. You may consult with your installer for changing Cloud Storage Service Package.
No Suspension. You can stop recording at any time during the subscription. The subscription will not be cancelled or extended by stopping recording. After you stop recording, the device will not record any new video clips in the cloud storage, but you can view and playback the video clips and the alarm history within the storage period.
For example, you are on a 7-day cloud storage plan, when you decide to stop recording on Jan. 8th, you can playback the history recorded from Jan. 1st to the moment you stop recording. On the following day, you can view and playback the history recorded from Jan. 2nd to Jan. 8th. By Jan. 15th, all the data will exceed the number of days of storage and be erased.
Once the subscription is activated, the subscription period starts immediately, and it will not stop when you stop recording. For example, you activate the service on Aug 15th, and your subscription period is one month. If you stop the cloud recording between Aug 20th and Aug. 30th, the subscription period still ends on Sep 15th.
Non-commercial use. You agree that the Service is for non-commercial use only. Without the prior written consent of MAZi, you shall not use this Service for any commercial purposes.
Requirements. You understand and agree that you will have to prepare the following equipment and bear the following expenses by yourself in order to use Cloud Storage Service:
1) Hardware devices that support this Cloud Storage Service;
2) Internet access equipment, including but not limited to computers or other Internet terminals, modems and other necessary Internet access devices;
3) Internet access expenses, including but not limited to Internet access fees, Internet equipment rental fees, mobile phone traffic charges, etc.
You shall also ensure to meet the following requirements before using the Cloud Storage Service, including:
1) High-Speed Internet Connection (1.5Mbps+);
2) Mobile OS OS: iOS 10.0+ (iPhone, iPad), Android 5.0+;
3) The latest firmware of your device.
Deleting your data. You can delete your device data at any time during the subscription. When you delete device data, you will clear your video and alarm history in the Cloud Storage associated with the selected device. There is no option for recovery once the data is permanently deleted. Your Cloud Storage subscription will not be stopped, cancelled or extended by deleting the device data.
Deleting your device. You can delete your device at any time during the subscription. When you delete your device, the video cannot be viewed or playback even though they are still retained on the Cloud Storage until the storage time expires. However, after the device is re-added to your account, you can still view or playback the video as long as it is still valid per your subscription.
While we strive for the Cloud Storage Service to be highly reliable and available, it is not intended to be reliable or available 100% of the time. Cloud Storage Service suspension or interruption may occur during the subscription when;
1) The device is offline due to Wi-Fi intermittency, service provider uptime, and failures for a variety of reasons beyond our control.
2) The device fails to upload the video to the cloud due to the bandwidth limit.
3) The device is deleted from your account.
4) The cloud recording is stopped.
You can consult your installer about whether you can cancel and how to cancel your subscription. Different installers may have different cancellation policies, so we strongly suggest to consult your installer before cancellation.
You will not be billed automatically after the current subscription period ends. The device will record video till the last day of your subscription. You can view and playback the video and the associated alarm history within the storage period after the end of subscription.
When you use the Services, the videos will be stored on the cloud in encrypted form. Only you have the keys to decrypt it.For the information of any third party individuals who are collected and processed via the devices owned by you, MAZi will process such data, as a processor, on your behalf. MAZi only retains video from your devices for the duration according to your subscription package. We kindly remind that you, as a controller of such third party data, are liable to collect and process such data in accordance with applicable laws and regulations.
At all times, information collected by MAZi will be treated in accordance with MAZi Platform Privacy Policy.
We may change, upgrade, discontinue, or temporarily suspend any feature or component of Cloud Storage Service at any time unilaterally and without prior notice as a result of business development needs, system failure, maintenance and repair, updates, adjustments, or other circumstances. You acknowledge that you may be required to install software updates to use Cloud Storage Service with the device, and you agree to promptly install such updates we provide. You are solely liable for any losses arising from a failure to timely implement such updates. You acknowledge and agree that you will not be entitled to any refund or rebate in those conditions.
You acknowledge that you provide the video clips and your personal information at your own risk. You are solely responsible for the video clips stored with Cloud Storage. MAZi only provides technical support related to the Service and has no control over the video clips stored. Therefore, MAZi cannot guarantee the legality, correctness, integrity, authenticity of any content stored by you.
It is not allowed to store any content through Cloud Storage Service that violates applicable laws and regulations. MAZi reserves the right to immediately delete such content which does not comply with applicable laws and regulations if requested by the authorities and suspend or terminate the provision of some or all of the service to you.
You agree to defend, indemnify, and hold MAZi, its affiliates, directors, officers, employees, shareholders, contractors, agents, licensors, and suppliers harmless from any damages, liabilities, claims, demands, losses, or expenses, including attorneys’ fees, made by any third party due to or arising out of or in connection with (i) your abuse or misuse of Cloud Storage Service and devices; (ii) your violation of the Terms; (iii) your violation of any law or the rights of any third party. MAZi will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.
These Terms are integral part of the MAZi Platform Terms of Service, and all other matters not specifically covered by the Terms shall be referred to MAZi Platform Terms of Service.
